The CloudSource website is provided for general business, informational and communication purposes.
You may use the website only for lawful purposes and in accordance with these Terms. You may not use the website in a manner that could damage, disable, interfere with or compromise the website, CloudSource systems, other users or third parties.
You may not attempt to gain unauthorized access to any systems, accounts, networks, data or functionality associated with CloudSource or its service providers.
2. CloudSource Products and Services
These Terms govern use of the CloudSource website and its publicly available features.
CloudSource products and services purchased by customers are governed by the applicable proposal, quote, statement of work, master services agreement, service agreement or other agreement between CloudSource and the customer.
If there is a conflict between these Terms and an applicable customer agreement regarding purchased products or services, the applicable customer agreement controls.
Pricing, service levels, payment terms, contract terms, warranties and other commercial terms applicable to CloudSource services are established through the applicable customer agreement and are not established by these website Terms.
3. Technology and Security Assessments
CloudSource may offer complimentary or paid technology and security assessments.
These assessments are intended to help organizations better understand their current technology environment, identify potential gaps and consider areas that may warrant additional attention.
Assessment findings are based on information made available to CloudSource, discussions with the organization, publicly observable information and the scope of the particular assessment.
Unless expressly agreed otherwise in writing, an assessment is not a penetration test, security certification, regulatory audit or guarantee that an organization’s systems are secure, free from vulnerabilities or compliant with any particular law, regulation, framework or standard.
Organizations remain responsible for determining their own legal, regulatory, contractual and compliance obligations.
4. Publicly Available Security Information and Website Tools
CloudSource may provide tools or processes that evaluate publicly available information associated with internet domains, email configurations or other externally observable technology characteristics.
By voluntarily submitting a domain or other information to such a tool, you represent that you are authorized to submit that information for the requested purpose.
These tools are intended to provide informational insights and may rely on automated processes and publicly available information. Results may be incomplete, change over time or require additional technical investigation.
Use of these tools does not constitute unauthorized access to private systems and should not be interpreted as a comprehensive vulnerability assessment, penetration test, certification or compliance determination.
5. Intellectual Property
Unless otherwise stated, the website and its content, including text, graphics, logos, designs, service names, reports, materials and other content, are owned by or licensed to CloudSource and are protected by applicable intellectual property laws.
You may view and use publicly available website content for legitimate personal or internal business purposes.

Reports, assessments or other materials provided directly to a customer or prospective customer may be subject to additional terms applicable to those materials.

CloudSource does not control and is not responsible for the content, availability, privacy practices, security or terms of third-party websites or services.
The inclusion of a third-party link does not necessarily constitute an endorsement of that third party.

CloudSource works to maintain useful and accurate website information, but we do not guarantee that every page, tool or resource will always be available, complete, current or error-free.

9. SMS Messaging Terms & Conditions
CloudSource Global, Inc. may offer SMS and MMS communications to customers, prospective customers and other individuals who have consented to receive messages where consent is required.
The CloudSource Messaging Program may include informational messages such as service notifications, support communications, account notifications, security notifications, appointment or scheduling communications, and other messages related to your relationship with CloudSource.
Message frequency varies. Message and data rates may apply.
Consent to receive text messages is not a condition of purchasing any CloudSource product or service.
To opt out, reply STOP at any time. After opting out, you may receive a confirmation message indicating that you have been unsubscribed.

Carriers are not liable for delayed or undelivered messages.
Your use of CloudSource SMS and MMS communications is also subject to our Privacy Policy, including our commitments concerning mobile information and SMS opt-in data.
CloudSource may modify or discontinue a messaging program, subject to applicable law and carrier requirements.
10. Customer Use of CloudSource Messaging Services
CloudSource may provide CloudVoice and other VoIP or communications services that enable business customers to send or receive SMS or MMS messages.
Customers using those capabilities are responsible for their own messaging programs and for complying with applicable laws, regulations, carrier requirements and industry standards, including requirements relating to campaign registration, recipient consent, opt-in disclosures, message content, opt-out requests and recordkeeping.
CloudSource’s Privacy Policy and these Messaging Terms do not constitute consent on behalf of a customer’s recipients and do not replace a customer’s own privacy policy, terms and conditions, messaging disclosures or compliance obligations.
11. Privacy
Your use of the website is also subject to the CloudSource Privacy Policy, which describes how CloudSource collects, uses and protects information.
12. Disclaimer of Warranties
To the extent permitted by applicable law, the website and its publicly available content and tools are provided on an “as is” and “as available” basis.
CloudSource disclaims warranties regarding the operation, availability, accuracy or completeness of the website except where such warranties cannot legally be excluded.
Nothing in this section modifies any express warranty or service commitment contained in a separate written customer agreement with CloudSource.
13. Limitation of Liability
To the extent permitted by applicable law, CloudSource will not be liable for indirect, incidental, special, consequential or punitive damages arising solely from your use of or inability to use this website or reliance on its publicly available content.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
Liability relating to purchased CloudSource products or services is governed by the applicable customer agreement.
14. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless CloudSource Global, Inc. and its officers, employees and representatives from claims, liabilities, damages or expenses arising from your unlawful use of the website, violation of these Terms or infringement of another party’s rights through your use of the website.
15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any dispute arising solely from use of this website will be subject to applicable law and the jurisdiction of courts having authority in Florida, unless otherwise required by law.
Disputes concerning purchased CloudSource products or services are governed by the dispute-resolution and governing-law provisions contained in the applicable customer agreement.
16. Changes to These Terms
CloudSource may update these Terms periodically to reflect changes in our website, services, business practices or legal and regulatory requirements.
The Last Updated date at the top of this page will identify the most recent revision.
Your continued use of the website following an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.
